This Privacy Policy (“Policy”) describes Art in Action’s (herein referred to as “we”, “us”, or “Art in Action”) practices regarding the collection and use of information submitted through our U.S. website, http://www.artinaction.org (the “Site”). By using our Site, you (“you”) agree to the collection and use of information as set forth in this Policy. If you do not agree to this Policy, please do not use the Site. This Policy is the sole authorized statement of our practices concerning the collection, use and protection of personal information through this Site.

We may update this Policy from time to time. We will notify you of material changes to this Policy by using any means, including by posting the updated Policy on this page or by sending electronic mail. Your continued use of the Site after such notice will be deemed acceptance of such changes. Be sure to return to this page periodically to ensure familiarity with the most current version of our Policy. You can determine when this Policy was last updated by checking the date after “LAST UPDATED” line at the top of this Policy.

The Types of Information We Collect Online

a. Personal Information

Our Site collects personal information such as names, postal addresses, email addresses, telephone numbers, and other information, such as survey responses. If you make a purchase on our Site, we may collect your credit card information (or other applicable payment mechanism information) as well as other information related to your purchase.

b. Non-Personal Information

Like many websites, our Site monitors visitor traffic patterns by logging tracking data, which is collected automatically from each Site visitor. Tracking data may include information such as the IP address of the visitor’s computer, its browser type and operating system, the referring site, which pages of the Site were visited, the order in which they were visited, and which links were clicked.

2. How We Use and Disclose Information Collected Online

We generally use the information we collect online for the purposes for which it is provided and to enhance the products and services we offer to you. For example, we use your personal information to complete transactions that you enter into using our Site. We also use your personal information to communicate with you about specific transactions, to make sure that you are satisfied with our products and services, or to find out how we can serve you better. You may, from time to time, receive information from us regarding new products, services, resources or features we think you will find valuable.

We use tracking data and information obtained through cookies and other technologies to help diagnose problems with our servers, to administer our Site, and to improve Site-related services and features. This data also may be used to analyze traffic patterns and Site usage trends. We also may share aggregated statistical data and other non-personally identifiable information with our current and potential business partners.

We work with third parties who provide services that may include, but are not necessarily limited to, website hosting, data processing and analysis, back-up and security services, and processing of credit card transactions. We may share personal information with these service providers for the purpose of providing these services. Although we seek to require these service providers to protect such personal information, and to use it only for the purpose for which it was provided, we cannot be responsible for third parties’ violations of this Policy or of any other rights of visitors or consumers that use our Site.

We will provide personal information to law enforcement and other entities when we determine that such disclosure is required by subpoena, warrant, court order, or other applicable law or process. We may also disclose such information in cooperation with a law enforcement or government request or where we believe it is necessary to investigate, prevent, or take action regarding illegal activities, suspected fraud or infringement of proprietary rights, situations involving threats to the physical safety of any person, violations of our Terms of Use, or otherwise to comply with legal or regulatory obligations.

We may provide personal information and other information collected online to a purchaser or successor entity in the event of a sale of our business or assets.

The Google Analytics features Art in Action has implemented is based on Display Advertising (e.g., Remarketing, Google Display Network Impression Reporting, the DoubleClick Campaign Manager integration, or Google Analytics Demographics and Interest Reporting).

Visitors can opt-out of Google Analytics for Display Advertising and customize Google Display Network ads using the Ads Settings.

Art in Action will not facilitate the merging of personally-identifiable information with non-personally identifiable information previously collected from Display Advertising features that is based on the DoubleClick cookie unless you have robust notice of, and the user’s prior affirmative (i.e., opt-in) consent to, that merger.

If you wish to hide all of your browsing behavior you can use Google Analytics opt-out browser add-on.

3. Security

We take measures designed to prevent unauthorized intrusion to the Site and the alteration, acquisition or misuse of personal information. Unfortunately, however, no security system or system of transmitting data over the Internet can be guaranteed to be entirely secure. Thus, while we seek to protect your personal information, we cannot be responsible for loss, corruption, or unauthorized acquisition of personal information furnished to this Site or for any resulting damages.

4. Third Party Websites

Our Site may include links to other Internet websites, including sites that we do not own or operate. Unless otherwise expressly stated, we are not responsible for the privacy practices or the content of such websites, including such sites’ use of any information collected when Site visitors click through links to those sites. If you visit such websites, we encourage you to check the privacy practices of the sites.

5. Offline v. Online Practices

This policy applies solely to our collection, use and disclosure of personal information obtained online through our Site, and does not apply to any of our practices conducted offline.

TERMS OF USE

These Terms govern your access to the Art in Action website, its use, and the resources and other materials contained therein (collectively, the “Site”).

We reserve the right at any time to change all or any part of these Terms; change the Site, including by eliminating or discontinuing any content on or feature of the Site; and change any fees or charges for use of the Site. Any changes we make will be effective immediately upon notice, which we may provide by any means including, without limitation, posting on the Site or by electronic mail. Your continued use of the Site after such notice will be deemed acceptance of such changes. Be sure to return to this page periodically to ensure familiarity with the most current version of these Terms. Upon our request, you agree to sign a non-electronic version of these Terms.

1. Registration

When and if you set up your Art in Action account and/or register to use the Site, you agree to (a) provide accurate, current and complete information about yourself as prompted by our registration form (including your email address), and (b) maintain and update your information (including your email address) to keep it accurate, current and complete. You acknowledge that, if any information provided by you is untrue, inaccurate, not current or incomplete, we reserve the right to terminate your access to and use of the Site. Our use and disclosure of any such information that you provide is governed by our Privacy Policy above.

As part of the account set-up and/or registration process, you may be asked to select a user name and password. We may refuse to grant you a user name for any reason in our sole discretion, including without limitation, in the event that we determine that such user name impersonates someone else, is illegal, vulgar, or otherwise offensive, or is protected by trademark or other proprietary rights law, or otherwise may cause confusion. You will be responsible for the confidentiality and use of your user name and password and agree not to transfer, loan or resell your use of or access to the Site to any third party. YOU ARE ENTIRELY RESPONSIBLE FOR MAINTAINING THE CONFIDENTIALITY OF YOUR USERNAME AND PASSWORD AND FOR ANY AND ALL ACTIVITIES (INCLUDING PURCHASES, AS APPLICABLE) THAT ARE CONDUCTED THROUGH YOUR ACCOUNT.

2. Materials

The information and materials provided through the Site, including, without limitation, any data, text, graphics, images, audio and video clips, logos, icons and links (collectively, the “Materials”) are intended to assist you with Art in Action’s art education programs. You must retain all copyright and other proprietary notices on downloaded and copied Materials, and any such downloads or copies are subject to the terms and conditions of these Terms. You may not download, copy or use any of the Materials except as expressly authorized by these Terms or in a separate agreement. In any event, you may not distribute, modify, transmit or publicly display the Materials without the written consent of Art in Action and/or, if applicable, its licensors or suppliers. Modification of the Materials or use of the Materials for any other purpose is a violation of our copyright and other proprietary rights, and is strictly prohibited.

3. Ownership

The Site is owned and operated by Art in Action in conjunction with others pursuant to contractual arrangements, and the Materials (and any intellectual property and other rights relating thereto) are and will remain the property of Art in Action and its licensors and suppliers. The Site, the Materials and the selection, compilation, collection, arrangement and assembly thereof are protected by U.S. and international copyright, trademark and other laws, and you acknowledge that these rights are valid and enforceable. You acknowledge that you do not acquire any ownership rights by using the Site or the Materials.

4. Your Use of the Site

Subject to and conditioned upon your compliance with these Terms, and unless otherwise specified on the Site, we grant to you a non-exclusive, non-transferable, non sublicensable, limited right and license to access and use the Materials available on the Site (other than your Submissions), solely as made available by us and solely for your own personal purposes. While using the Site, you agree not to:

  • Defame, abuse, harass, stalk, threaten or otherwise violate the rights of others, including without limitation others’ privacy rights or rights of publicity;

  • Impersonate any person or entity, falsely state or otherwise misrepresent your affiliation with any person or entity, or use any fraudulent, misleading or inaccurate email address or other contact information;

  • Restrict or inhibit any other user from using the Site, including, without limitation, by means of “hacking” or defacing any portion of the Site;

  • Violate any applicable laws or regulations;

  • Express or imply that any statements you make are endorsed by us, without our prior written consent;

  • Upload to, transmit through, or display on the Site (a) any material that is unlawful, fraudulent, threatening, abusive, libelous, defamatory, obscene or otherwise objectionable, or infringes our or any third party’s intellectual property or other rights; (b) any confidential, proprietary information or trade secret of any third party; or (c) any advertisements, solicitations, chain letters, pyramid schemes, investment opportunities or other unsolicited commercial communication (except as otherwise expressly permitted by us);

  • Engage in spamming or flooding;

  • Transmit any software or other materials that contain any viruses, worms, trojan horses, defects, date bombs, time bombs or other items of a destructive nature;

  • Modify, adapt, sublicense, translate, sell, reverse engineer, decompile or disassemble any portion of the Site;

  • Remove any copyright, trademark or other proprietary rights notices contained in or displayed on any portion of the Site;

  • “Frame” or “mirror” any portion of the Site, or link to any page of or material on the Site other than the URL located at http://www.artinaction.org/ or the URLs provided by us to you for such purposes as part of the Site, without our prior written authorization;

  • Use any robot, spider, site search/retrieval application or other manual or automatic device or process to retrieve, index, “data mine” or in any way reproduce or circumvent the navigational structure or presentation of the Site; or

  • Harvest or collect information about users of the Site without their express consent.

We may terminate your access to and use of the Site immediately if you fail to comply with the above rules.

5. Your Submissions

In the event that you post or upload to the Site, or otherwise submit to Art in Action in connection with your use of the Site, any materials, including, without limitation, photographs, images, text, graphics, sounds, data, links and other materials, (collectively, “Submissions”), you will retain ownership of such Submissions, and you hereby grant us and our designees a worldwide, non-exclusive, sublicenseable (through multiple tiers), assignable, royalty-free, fully paid-up, perpetual, irrevocable right to use, reproduce, distribute (through multiple tiers), create derivative works of, publicly display and perform and otherwise exploit such Submissions, solely in connection with the Site. You represent, warrant and covenant that you own or otherwise possess all necessary rights with respect to your Submissions, and that your Submissions do not and will not infringe, misappropriate, use or disclose without authorization, or otherwise violate any intellectual property or proprietary right of any third party, and are not unlawful, fraudulent, threatening, abusive, libelous, defamatory, obscene or otherwise objectionable or unlawful.

None of the Submissions will be subject to any obligation, whether of confidentiality, attribution or otherwise, on our part and we will not be liable for any use or disclosure of any Submissions. You acknowledge and agree that we may (but are not obligated to) do any or all of the following, at our discretion: (a) monitor and/or filter any Submissions (including, without limitation, by means of blocking or replacing expletives or other language that may be deemed harmful or offensive); (b) alter, remove, or refuse to send, transmit or otherwise use any Submission; and/or (c) disclose any Submissions, and the circumstances surrounding the transmission or use thereof, to any third party in order to operate the Site; to protect our affiliates, distributors, partners, licensors, advertisers, sponsors, and users; to comply with legal obligations or governmental requests; to enforce these Terms; or for any other reason or purpose.

We recommend you keep back-up copies of your Submissions on your hard drive or other personal system, as the Site is not intended to be used as a back-up solution for storing your Submissions.

6. Forums

The Site may permit users to share their Submissions with other users, including through our online user forums and blogs (collectively, “Forums”). Some Forum participants may use anonymous screen names and may have no other connection with Art in Action. A large volume of material is available in our Forums and Forum participants may occasionally post messages or make statements, whether intentionally or unintentionally, that are inaccurate, misleading or deceptive. We neither endorse nor are responsible for such messages or statements, or for any opinion, advice, information or other utterance made or displayed on the Site by third parties, whether such third parties are users of the Site or others. The opinions expressed in the Forums reflect solely the opinions of the participants and may not reflect the opinions of Art in Action. We are not responsible for any errors or omissions in articles or postings, for hyperlinks embedded in messages or for any results obtained from the use of such information. Under no circumstances will we or our affiliates, suppliers or agents be liable for any loss or damage arising from your reliance on such information obtained through the Site. We may, but have no obligation to, monitor the Forums and any materials displayed, transmitted or otherwise made available on or through the Forums. You acknowledge and agree that we have the right (but not the obligation) to monitor the Site and the Forums and your Submissions, and to alter or remove any such Submissions.

7. Making Purchases

If you wish to purchase any products or services through the Site, we will ask you to supply certain information applicable to your purchase, including, without limitation, payment and other information. Any such information will be treated as described in our Privacy Policy. All information that you provide to us or our third party payment processor must be accurate, current and complete. You agree to pay all charges incurred by you or any users of your account and credit card (or other applicable payment mechanism) at the prices in effect when such charges are incurred. You will also be responsible for paying any applicable taxes relating to your purchases. Verification of information applicable to a purchase may be required prior to our acceptance of any order. Price and availability of any products or services are subject to change without notice, and our current prices can be found on the Site. Title and risk of loss for any purchases pass to you upon our delivery to our carrier.

8. Links to Third-Party Sites or Materials

The Site contains links to other Internet websites which may or may not be owned or operated by Art in Action. Art in Action has not reviewed all of the websites that are linked to the Site, and Art in Action has no control over such websites. Art in Action is not responsible for the content and operation of such websites, any updates or changes to such websites, or the privacy or other practices of such sites, and the fact that Art in Action offers such links does not indicate any approval or endorsement of any material contained on any linked website. Art in Action is providing these links to you only as a convenience. Accordingly, we strongly encourage you to become familiar with the terms of use and practices of any linked website. Further it is up to you to take precautions to ensure that whatever links you select or software you download is free of such items as viruses, trojan horses, defects, date bombs and other items of a destructive nature.

9. Copyright Issues

Art in Action is committed to protecting copyrights and expects users of the Site to do the same. The Digital Millennium Copyright Act of 1998 (the “DMCA”) provides recourse for copyright owners who believe that material appearing on the Internet infringes their rights under U.S. copyright law. If you believe in good faith that any material used or displayed on or through the Site infringes your copyright, you (or your agent) may send us a notice requesting that the material be removed, or access to it blocked. 10. Term and Termination

These Terms shall remain effective until terminated as set forth herein. We may immediately terminate these Terms, and/or your access to and use of the Site or any portion thereof, at any time and for any reason, with or without cause, upon notice to you. Upon termination of these Terms, you will cease all use of the Site. Except for the license to access and use the Site granted to you in Section 2, the rights and obligations of the parties as set forth herein will survive termination.

11. Access By Minors

Pursuant to 47 U.S.C. Section 230(d), as amended, we hereby notify you that parental control protections (such as computer hardware, software or filtering services) are commercially available that may assist you in limiting access to material that is harmful to minors. THE SITE, INCLUDING ALL MATERIALS INCORPORATED THEREIN, IS PROVIDED “AS IS” AND WITHOUT WARRANTIES OF ANY KIND. TO THE FULLEST EXTENT PERMISSIBLE BY APPLICABLE LAW, ART IN ACTION AND ITS AFFILIATES, PARTNERS, LICENSORS, SUPPLIERS, ADVERTISERS, SPONSORS AND AGENTS DISCLAIM ALL WARRANTIES, EXPRESS, IMPLIED OR OTHERWISE, INCLUDING, WITHOUT LIMITATION, IMPLIED WARRANTIES OF TITLE, NON-INFRINGEMENT, ACCURACY, MERCHANTABILITY, AND FITNESS FOR A PARTICULAR PURPOSE, AND ANY WARRANTIES THAT MAY ARISE FROM COURSE OF DEALING, COURSE OF PERFORMANCE OR USAGE OF TRADE. TO THE FULLEST EXTENT PERMISSIBLE BY APPLICABLE LAW, NEITHER ART IN ACTION NOR ANY OF OUR AFFILIATES, PARTNERS, LICENSORS, SUPPLIERS, ADVERTISERS OR SPONSORS, NOR OUR OR THEIR DIRECTORS, OFFICERS, EMPLOYEES, CONSULTANTS, AGENTS OR OTHER REPRESENTATIVES, ARE RESPONSIBLE OR LIABLE FOR ANY INDIRECT, INCIDENTAL, CONSEQUENTIAL, SPECIAL, EXEMPLARY, PUNITIVE OR OTHER SIMILAR DAMAGES (INCLUDING, WITHOUT LIMITATION, DAMAGES FOR LOSS OF BUSINESS, LOSS OF DATA OR LOST PROFITS), UNDER ANY THEORY (WHETHER IN CONTRACT, TORT, STATUTORY, OR OTHERWISE) ARISING OUT OF OR RELATING IN ANY WAY TO THE SITE AND/OR MATERIALS. THE SITE OR THE MATERIALS, UNDER ANY THEORY (WHETHER IN CONTRACT, TORT, STATUTORY, OR OTHERWISE) SHALL BE THE GREATER OF THE TOTAL AMOUNT PAID BY YOU TO ACCESS THE SITE OR $100. Some states do not allow the exclusion or limitation of incidental or consequential damages, so the above limitation or exclusion may not apply to you.

16. Miscellaneous

These Terms are governed by and construed in accordance with the laws of the State of California, United States of America, without regard to its principles of conflicts of law. You agree to submit to the exclusive jurisdiction of any State or Federal court located in the County of San Mateo, California, United States of America or in the Northern District of California, and waive any jurisdictional, venue or inconvenient forum objections to such courts. If any provision of these Terms, or the application thereof to any person, place or circumstance, shall be held by a court of competent jurisdiction to be invalid, void or otherwise unenforceable, such provision shall be enforced to the maximum extent possible, or, if incapable of such enforcement, shall be deemed to be deleted from these Terms, and the remainder of these Terms and such provisions as applied to other persons, places and circumstances shall remain in full force and effect. No waiver by either party of any breach or default hereunder shall be deemed to be a waiver of any preceding or subsequent breach or default, nor shall any delay or omission on the part of either party to exercise or avail itself of any right or remedy that it has or may have hereunder operate as a waiver of any right or remedy. This, along with any separate, license agreement that you may enter into with Art in Action relating to the Materials, is the entire agreement between us relating to the subject matter herein and supersedes any and all prior or contemporaneous written or oral agreements between us with respect to such subject matter. (In the event of any conflict between these Terms and such license agreement, the terms of the license agreement shall prevail.) These Terms are not assignable, transferable or sub-licenseable by you except with our prior written consent. These Terms may not be modified or amended except as set forth in the introductory section of these Terms. Any heading, caption or section title contained in these Terms is inserted only as a matter of convenience and in no way defines or explains any section or provision hereof.
